This Blog Post is a PSA (i.e. a "Public Service Announcement" that's designed to provide the folks with important information) but it also both marks the rollout of this latest batch of #HaberPA's VideoFAQs and highlights # 383) "How do I get a Warrant Set-Aside?" and finally it's a shameless plug for #MichaelHaberLaw (#HaberPA's YouTube channel). Disclosures complete let's get to it:
- The PSA: #HaberPA's VideoFAQ # 383 offers options and suggestions as to how to get rid of a warrant and goes like this:
"There are precious few “universal truths” in this world. For instance, the Sun rises from the East and sets in the West, even if you’re a “Flat Earther” the Earth is gonna revolve around our Sun, all human beings are mortal - meaning we’re all born and we’ll all die - and when it comes to warrants, well, they never, ever expire. Yes... just as the Sun will rise in the East every morning, precisely as the Earth will continue it’s annual orbit around sun and like each of us will at some point pass on, another universal truth - more accurately stated: a universal criminal justice system truth - is that unless and until it’s either served or vacated, a warrant will never, ever, expire. Yup, if you have a warrant then unless and until it’s either served or set-aside, it’s gonna outlive you.
The good news is that there are 3 ways to make a warrant disappear: First you can surrender, second, you can get caught and third you can petition to have the warrant set-aside by the Judge who issued it.
As to surrender: If you have a warrant then you’re perfectly free to either walk into a police station - or to call the cops to you - and voluntarily submit yourself to the authorities. If you do that then your warrant will go bye-bye, but so too will you, at least for a little while.
As to getting caught: The net effect of being caught is the same as a surrender - meaning that your warrant will go bye-bye, but so too will you. The main difference between a surrender and getting caught is that no mater what the circumstances, with a surrender the cops, the Prosecutor and the Judge are all gonna have to acknowledge that you came to them voluntarily, through the proverbial front door, as opposed to involuntarily, through the back door and likely shackled.
As to Petitioning the Court to Set-Aside a warrant: When you want a Judge to rule on a matter - quashing / setting-aside a warrant included - then you need to prepare a legally sufficient motion, electronically file it, serve it on all relevant parties, calendar it for hearing - with sufficient time for all other parties to respond and appear - and then litigate it. That’s the legal process and it’s best accomplished by a criminal defense lawyer."

Each #HaberPA VideoFAQ focuses on a specific question, most are 1 - 2 minutes long, but several in this latest batch are closer to the 3 minute mark (another relevant aside alert: "Necessity" is what we call an "affirmative defense", or a defense which negates the "intent" or Mens Rea" element of an otherwise criminal act as the actor's illegal conduct only occurred under threat, usually threat of harm), and while we may not always be successful in our endeavor we do consistently strive to make each VideoFAQ short, pointed, creative, entertaining and, most importantly, informative.
While I admittedly conjure a healthy percentage of the "questions" that form our VideoFAQs a substantial portion of them are in fact inspired by real world questions from others (e.g. clients, potential clients, random folks on social media / the internet, friends, family, colleagues, etcetera).
