This Blog Post is a PSA (i.e. a "Public Service Announcement" that's designed to provide the folks with important information) but it also both marks the rollout of this latest batch of #HaberPA's VideoFAQs and highlights # 381) "How do I know if I have a Warrant?" and finally it's a shameless plug for #MichaelHaberLaw (#HaberPA's YouTube channel). Disclosures complete let's get to it:
- The PSA: #HaberPA's VideoFAQ # 381 discusses the nature of warrants and goes like this:
"Thanks for asking me “How do I know if I have a Warrant?”
Let’s start with this... If you’re being investigated by the government, be it State or Federal, then the overwhelming odds are that the investigation is being done secretly. It’s a rare case - although not unheard of - where the Cops come to you and let you know that you’re under investigation. Still, in many circumstances your warrant may be very public and in others “you should know”. What do I mean? It depends upon both the type of warrant and “the why” of the warrant.
When it comes to search warrants there’s almost never any sort of advance notice, and the reason is obvious. For example: If law enforcement’s suspicious eye is focused on you, let’s say for a narcotics investigation - perhaps they have information from a Confidential Source that you deal dope out of your home - or maybe you’ve been caught up in an undercover police internet sting operation - say for prostitution or for child porn - in either of these circumstances you’re not going to get any warning - or advance notice - from the cops. Why? Because the most reasonably foreseeable probability of advising you is that you’ll secret, destroy or otherwise tamper with the very evidence that an impromptu, concealed and spontaneously served search warrant would otherwise uncover.
When it comes to arrest warrants the same logic can hold true -for instance, the cops may not want Mr. X to know that their gunning for him because if he knows then he may flee; however, with many arrest warrants there’s no big secret. For instance, if you fail to appear for a criminal case then a Bench Warrant issues, and it does so, both on the record in a public courtroom and then it’s entered into the Clerk’s public docket. The same holds true for a Writ of Bodily Attachment (which is an arrest warrant for failing to pay court ordered support, be it child, alimony or other), as well as for various “detainers” or “holds” which are placed on someone who’s in custody by some other entity which also has a claim on that same person, such as an Immigration / ICE hold or an Extradition Warrant.
You can always search for yourself in various databases - for instance your local Clerk of Court or the FDLE / FL Dept. Of Law Enforcement ,which operates a website called “The Florida Crime Information Center, Public Access System” - and maybe, just maybe, your warrant will pop-up."

Each #HaberPA VideoFAQ focuses on a specific question, most are 1 - 2 minutes long, but several in this latest batch are closer to the 3 minute mark (another relevant aside alert: "Necessity" is what we call an "affirmative defense", or a defense which negates the "intent" or Mens Rea" element of an otherwise criminal act as the actor's illegal conduct only occurred under threat, usually threat of harm), and while we may not always be successful in our endeavor we do consistently strive to make each VideoFAQ short, pointed, creative, entertaining and, most importantly, informative.
While I admittedly conjure a healthy percentage of the "questions" that form our VideoFAQs a substantial portion of them are in fact inspired by real world questions from others (e.g. clients, potential clients, random folks on social media / the internet, friends, family, colleagues, etcetera).
