This Blog Post is a PSA (i.e. a "Public Service Announcement" that's designed to provide the folks with important information) but it also both marks the rollout of this latest batch of #HaberPA's VideoFAQs and highlights # 382) "What should I do if I have a Warrant?" and finally it's a shameless plug for #MichaelHaberLaw (#HaberPA's YouTube channel). Disclosures complete let's get to it:
- The PSA: #HaberPA's VideoFAQ # 382 offers options and suggestions should you know that you're the subject of a warrant and goes like this:
"Thanks for asking me “What should I do if I have a Warrant?”
Depending upon “the why” of your warrant, there may or may not be anything that you can do, not proactively anyhow. What do I mean? Let’s take a few examples:
Say you’re at home, watching TV, surfing the net, bathing your dog... whatever. Next thing you know you hear pounding at your door and the words “Police. Open up. We have a warrant.”... or, worse still, your door is busted open and a battalion of combat garbed officers are staring you down with automatic weapons pointed at you. In that circumstance there’s not much for you to do except to invoke your rights - or, as I like to say, #UPx2 (#UPx2 is a modified acronym that I created which is a literal abbreviation for “Shut-Up and Lawyer-Up”, or, Invoke both The 5th and The 6th). Similarly, if you’re diving down the roadside, perhaps over the river an through the woods to Grandmother’s house, when Officer Friendly lights you up and pulls you over, and, after running your driver’s license she or he orders you to exit you vehicle because you have a warrant, again, apart from wisely opting to #UPx2 there’s not much you can do.
On the other hand, if you either know or suspect that you have a warrant - for example, perhaps you know that you missed a court date, or maybe you know that a urine sample that you provided to your Probation Officer is gonna come up positive for controlled substances, or perchance you committed some crime and are relatively certain that you either were or will be identified - in any of these circumstances there are proactive measures that you can take, but they all start with hiring a local, skilled and experienced criminal defense lawyer.
More specifically, if a Bench Warrant for your arrest issued because you missed a court date then your lawyer can likely get an emergency hearing set within a day or 2, surrender you in open court and petition the Judge to set-aside the warrant. If you know that VOP is imminent then your lawyer can reach out to your PO, get the facts and advise that s/he is going to get an emergency hearing set. And if the Cops are looking for you then your lawyer can make things infinitely easier and far more convenient for you by reaching out to The PoPo and arranging for the most pleasant and safe situation possible, including pre-arrangements for bond."

Each #HaberPA VideoFAQ focuses on a specific question, most are 1 - 2 minutes long, but several in this latest batch are closer to the 3 minute mark (another relevant aside alert: "Necessity" is what we call an "affirmative defense", or a defense which negates the "intent" or Mens Rea" element of an otherwise criminal act as the actor's illegal conduct only occurred under threat, usually threat of harm), and while we may not always be successful in our endeavor we do consistently strive to make each VideoFAQ short, pointed, creative, entertaining and, most importantly, informative.
While I admittedly conjure a healthy percentage of the "questions" that form our VideoFAQs a substantial portion of them are in fact inspired by real world questions from others (e.g. clients, potential clients, random folks on social media / the internet, friends, family, colleagues, etcetera).
