Virginia Jail Bans Inmates from receiving Pictures in the Mail after photos which were Soaked in Liquid Suboxone are discovered ~ Call Michael A. Haber, Esq. @ 1-888-SHARK-8-1




After officials at the Western Virginia Regional Jail in Salem, Virginia, intercepted drug-soaked pictures in inmate's mail the facility is no longer allowing its inmates to receive personal photographs in the mail.


According to Bobby Russell, the jail superintendent, the intercepted photographs had been saturated in liquid suboxone (suboxone is a partial opioid which is used to treat opiate addiction) and the drug is able to be absorbed through chewing. Apparently it can be difficult for investigators to detect suboxone, especially on photos, but it reportedly leaves a slight yellow stain on white paper.  The bigger problem is that this process can be used with other substances, such as crystal meth... if the drug can be liquefied then it can saturate a variety of mediums.  



The jail had previously banned inmates from receiving papers containing drawings or paintings, as well as all nonwhite paper, and greeting cards are prohibited.  Why you ask?  Because apparently many greeting cards are embossed or raised on the front, and people were taking those cards, putting on a really thick coating of nontoxic glue and then taking a needle and injecting narcotics into that glue before it dries.  Once dried inmates could chew the greeting card (or other paper product) and enjoy the embossed narcotic (just like LSD).



As to the latest personal photograph ban, and per Bobby Russell:  "We stopped it at this point to determine our best avenue for detection or other alternatives for the inmates to receive pictures.  We understand people want to see their kids and family members and everything, but we have to think about the safety of the inmates."  Jail officials are looking into other ways for inmates to receive pictures, and they are also in discussions with a company the manufactures a "mail screening product".

Utah Mom seeks Protection of "Safe Haven" Law when she Abandons her "Rude and ungovernable" 8 year old at a Salt Lake City Hospital ~ Call Michael A. Haber, Esq. @ 1-888-SHARK-8-1




Meet 36 year old Kathy Sherrer of West Jordan, Salt Lake City, Utah, and definitely in contention for being the dumbest and saddest excuse for a mother on the planet. Yes, that's her below....



This genius took her eight (8) year old son (he is reportedly one of four siblings, aged aged 4, 8, 12 and 13, and all requiring special needs) to a local Salt Lake City hospital and left him there - yes, she abandoned her 8 year old boy - with a note that read:  "This kid is rude and ungovernable! I do not want him in my house at all!"



After her arrest for child abandonment (a felony) and child abuse (a misdemeanor) on Wednesday, March 9th, 2016 this disgrace of a mother told a local tv station that she was making use of the Utah's "Safe Haven" law.  The problem is that Utah's "Safe Haven" law (like most "Safe Haven" laws) only permits a parent to anonymously give up custody of newborn babies (many times up to the first three (3) days of life, and in only nine (9) States more than thirty (30) days after birth - but in no event after eight (8) years) at a "safe space".



This genius told KSL-TV (you can watch and listen to her by clicking here) that:  "I thought that it was OK that we could drop them off and it was a safe haven place.  I wasn't sure about the safe haven laws or what it meant… I really did not know any other way to go about it."




According to the police the young boy reportedly walked up to the reception area of the hospital n February 21 with a note from his mother, which detailed her complaints with him and his name.  The boy also reportedly had light bruising on his right arm from where his mother had allegedly hit him with a spoon.  Hospital authorities contacted police and the boy was then taken into protective custody. 



The mother (I just can't bring myself to call her by name) reportedly told cops that she was "overwhelmed" with the duties of childcare, as she has four (4) children, aged 4, 8, 12 and 13, all with special needs.  After charging her Salt Lake County District Attorney Sim Gill went on record stating the obvious:  A parent can not abuse the State's Safe Haven law and randomly leave their child(ren) where they please.  Per Mr. Gill:  "You don't get to arbitrarily drop children off at certain institutions.  You reach out to that organization, that organization helps process your child, there's an understanding. Everybody understands what everyone's role is.  Everyone knows what they're supposed to do. But you don't simply say, 'I've had enough and I'm going to drop off this child and no one knows who I am."'  



In my (perhaps not so) humble opinion Kathy Sherrer should be the Sh*t Parent of the Year, centerfold.

Social Media WIN! Dumb Criminal FAIL! TX Woman is Arrested after responding to a Police Facebook Sting Op about Meth being Tainted with Ebola ~ Call Michael A. Haber, Esq. @ 1-888-SHARK-8-1




Make no mistake about it: POLICE ABSOLUTELY DO CONDUCT STING OPERATIONS ON THE INTERNET (in fact you can Watch HaberPA's YouTube Webisode on "Do Police conduct Sting Operations on the Internet?" by clicking below...)!



On March 22nd, 2016 the Granite Shoals, TX Police Department's used social media to put out a fake alert on it' s Facebook page stating:  "Breaking News:  Area Meth and Heroin Supply Possibly Contaminated With Ebola" 



The post (which is pictured above and has been dubbed by some as a "Facebook Post Challenge",  or, if you ask the defense bar, a "Police Internet Sing Op") actually led to a woman's arrest after she showed up at the Granite Shoals Police Department to have her potentially contaminated contraband / meth screened with a "special device".  



Two days after the initial Facebook post, on Thursday, March 24th, 2016, 29 year old Chastity Eugina Hopson (pictured below) responded to the PD's warning that:  "If you have recently purchased meth or heroin in Central Texas, please take it to the local police or sheriff department so it can be screened with a special device.  DO NOT use it until it has been properly checked for possible Ebola contamination!"  When she showed up at the Granite Shoals Police Department with less than one gram of meth she was arrested and charged.



But the PD took heat when it went a step further and posted Chastity's mug shot on it's webpage, referring to her as the "winner" of their "Facebook post challenge".



Falling short of attacking the Sting Op itself, critics have claimed that the PD's act sharing the woman's name and picture and effectively poking fun at her addiction was, well, uncool.  One critic reportedly commented on the PD's "winner" pic stating that:  "You humiliated and shamed her and treated her like a criminal instead of like someone who has a disease.  I work I with addicts and one of the reasons they don't seek out help is the fear of judgement and because they feel ashamed.  You could have offered this woman treatment/help and instead you plastered her face all over Facebook reinforcing the beliefs of addicts that they are worthless and undeserving of help."  And, as the criticism began to pile up, the PD ultimately wrote in a post that it wanted to show "all parts of the enforcement world on Facebook, and that includes our sense of humor", but then, as of Monday, March 28th, 2016 both the original Ebola meth post as well as the "winner" post had been removed, and in their place was a picture of a cat, driving a car, with a caption that read: "'And now here is a picture of a cat." 



Naturally the ACLU chimed in... Matt Simpson, a senior policy strategist at the Texas ACLU questioned what a department like Granite Shoals would do in the event of a real contaminated drug crisis, stating:  "'Are they going to run another Facebook ad that looks like this, only it's designed to help people instead of ensnare people foolish enough to follow up?"


But, point-counterpoint, and Clint McNear, a law enforcement consultant and retired police officer, compared the "'Ebola meth post" to a tactic he once used when he would call a person with an outstanding warrant to say that someone had turned in a wallet full of cash with that person's name on it.  Per Clint:  "Clever ideas to catch criminals (are) not new, and as the criminal evolves, law enforcement evolves with them."  


Enter Tom Smith, Texas director of the advocacy group "Public Citizen", who called tactics like the Ebola post "pure deception", stating that:  "At a time when we're having a crisis with growing heroin addiction it's outrageous that we would set traps for people instead of coming up with strategies to get them into treatment."



Memo to the ACLU, "Public Citizen" and the Folks:  It's called an "Internet Police Sting Op" and it is only entrapment if the arrestee was not predisposed to commit the crime independent of the police deceit and trickery.  “Sting Op” is a law enforcement term that cops use when they embrace any of a variety of deceptive tactics to catch people who are predisposed to  committing crimes.  Sometimes the cops do it themselves “undercover” and other times they employ CI’s (confidential informants) or CS’s (cooperating sources).  There are many sorts of sting ops.  Some examples are: - Posing as someone who is seeking illegal drugs, contraband or child pornography to catch a supplier; or posing as a supplier to catch a customer (where the cops are the suppliers it is called a “reverse sting”) - Posing as a potential customer of illegal prostitution; or posing as a prostitute to catch a customer (again a “reverse stiong”) - Posing as a child in a chat room to identify a potential child molester - Posing as a hit man to catch customers and solicitors of murder-for-hire - Passing off explosives, fake or real, to a would-be terror bomber - Deploying a bait car (or a “honey trap”) to catch car thieves - Arranging someone under the legal drinking age to ask an adult to buy an alcoholic beverage or tobacco products for them... 



Memo to the ACLU, "Public Citizen" and the Folks continued:  Most folks caught in a sting think they were entrapped but very few actually were.   The fact is that cops are permitted to  use methods of persuasion, trickery or subterfuge in an effort to get you to commit a crime.  The question that determines whether or not you were entrapped is: Would you have done what you did if a civilian had been involved instead of the cops?  Further, some cops never leave the police station, instead their job is to literally sit at a work station and troll the internet looking for folks who go to, look in, download from or upload to targeted (and usually, but not always "deviant") sites.  The bottom line is that you must always be careful about engaging in any sort of criminal activity on the internet.  And, taking it a step further (even though it’s not technically a sting op), count on the fact that prosecutors will scour the internet looking for any incriminating information which they can use against you in any pending criminal case.  Forewarned is forearmed.

A "Legally Drunk" American Airlines Pilot is Arrested on the Tarmac and in the Cockpit after Failing Two Breathalyzer Tests before a 7:00 am Flight ~ Call Michael A. Haber, Esq. @ 1-888-SHARK-8-1




Meet 50 year old John Maguire, an American Airlines co-pilot who was arrested on Saturday, March 27th, 2016 for operating an aircraft under the influence of alcohol. 



Maguire was already in the cockpit of AA (no pun intended) Flight # 736, from Detroit to Philly, which was scheduled to depart at 6:59 am, when authorities entered the plane and required him to take a breathalyzer test (which he failed).
The test was precipitated by a TSA agent who reported Maguire after smelling alcohol on the co-pilot and finding his behavior to have been "odd".  




After the initial breath test found Maguire's BAC (blood alcohol content) to be above the 0.04 limit established by the Federal Aviation Administration the co-pilot was taken into custody on the tarmac.  


Maguire reportedly failed a second breathalyzer test after he was taken to the Police Department.



The early morning flight was cancelled, stranding several college students who were on their spring break, prompting American Airlines to release a statement advising that it would book customers on other flights and adding that:  "Safety is our highest priority and we apologize to our customers for the disruption to their travel plans."



Maguire was reportedly charged with a misdemeanor.



When it comes to the subject of drinking and flying, er driving, the best advice that you are ever going to hear is:  "Don't do it!  Get a DD (Designated Driver), not a DUI".


Be smart{er than John Maguire}: Don't drink and fly, er drive, but, if you do, just say "NO{thing}", don't blow (in FL your 2nd subsequent refusal is a crime) and call me stat at 305-381-8686, 305-798-2220 or 1-888-SHARK-8-1.
