MN Woman Bites off a Piece of her Husband's Ear during a fight over Beer... Denies it to the Cops but Admits it in Recorded Telephone Calls from the Jail ~ Call Michael A. Haber, Esq. @ 1-888-SHARK-8-1




Meet 37 year old Jamie Elrod of St. Cloud, Minnesota.  That's her below... 





Jamie was charged with first degree assault in the Stearns County District Court after she went all Mike Tyson on her husband, biting off a piece of his ear, allegedly during an argument over beer.  




When police arrived at their home they found Jamie, her husband (who was missing part of his right ear), blood and the piece of missing ear on the floor.  Per the cops Jamie's husband told said that he and Jamie had gotten into an argument over beer and that she "went off at him" while Jamie swore that she did not know what had happened to her husband's ear.






The cops did not buy Jamie's poorly feigned lack of knowledge and surprise, and their suspicion was proved reasonable by Jamie's subsequent stupidity in admitting to having bitten off part of her husband's ear during recorded phone calls made from her jail cell.

The FL Bar Rule says that, upon termination of representation, a lawyer should refund to the client any advance payment of a fee that has not been earned. This does not preclude a lawyer from retaining any reasonable non-refundable fee that the client agreed would be deemed earned when the lawyer commenced the client's representation.




In reality there are no solid answers to the issue of refunding legal fees.   is sticky, varies greatly and should ultimately boil down to a combination of a) the language in the retainer agreement and b) what is fair, just and appropriate under the circumstances.




There are Many times fees are nonrefundable and other times equity or good business compel a refund, in whole or in part.

Q:     Am i allowed to carry chef knives as "tools of the trade" to and from work if I'm a convicted felon?  I was interested in purchasing a higher quality set of knives but i don't have any where to lock them up at work and i don't trust my fellow employees to just leave them there. My past is not a violent one and I'm just wondering if this could possibly cause more trouble for myself. I understand the whole weapons and convicts legality issue but it is simply a tool to me, like a plumber and their monkey wrench, a carpenter and their hammer, etc. I just want to stay out of trouble, do i have any options here?

Answered Per F.S. 790.23 anything under 4 inches does not require a permit and is lawful, but over 4" a knife - "tool of the cooking trade or not" - is considered a weapon. No matter what the justification, as a convicted felon you can expect to have issues if you carry any knife (or other object which could reasonable be considered a weapon, even if not in a court of law).

I understand your need to use tools for your trade but you need to understand that, outside of the kitchen, nothing - I repeat "NOTHING" (caps intentional) good can come from your packing what is legally considered to be a weapon.

While you might not ultimately be convictable on a new weapons charge (i.e your lawyer may ultimately be able to convince a jury to either pardon you or that the cop who arrested you was harassing you) you are almost certain to find yourself cuffed, arrested and facing bond, legal fees and the possibility of losing...

I suggest that you explore options. See if your employer has s secure place for you to store your "tools". If not then I'd advise against it. The risk is simply too high.

After a Series of "Porch Thefts" a Las Vegas Man Intentionally Leaves a Package Filled with Dog Crap for the Thieves to Steal... and they do... ~ Call Michael A. Haber, Esq. @ 1-888-SHARK-8-1




Meet Eric Bardo of Las Vegas, Nevada.  That's him below....





Eric was victimized by having had several of his delivered packages which had been left outside on his doorstep stolen...





But rather than getting mad Eric decided to get even...





Eric found his revenge after installing a security system with cameras at his home.





What Eric discovered after checking his surveillance video was that the thieves were two (2) teenage boys, and so, rather than calling the cops, Eric, with the help of his beloved pooch, decided to leave a special delivery of his own for the thieves who'd been stealing packages from his porch.





In order to bait the thieves Eric intentionally left a package on his porch outside of his front door, but this package was, er, special.....





Yes, the package was filled with dog crap, and yes, the kids stole it.  About the incident Eric said:  "I was kind of excited and I just kept replaying it [the video]"  I just kind of wanted to give them back something.  Hopefully they don't do it again and they learn their lesson."

You most certainly can fire your lawyer.  In fact it's easy...




You may not know this - many client’s don’t - but in the attorney-client relationship the client is the boss.  Your lawyer works for you and, as your employee, your lawyer is subject to discharge just as any other employee would be with one big exception... You may still be liable to your lawyer for contractual fees or costs.  The issue of recovering fees that you have paid is a stickier situation and will depend on a case by case basis.  


But, before you get to the point of actually discharging your lawyer you should make the effort to speak with her or him and see if there is a way to come to a meeting of the minds, to regroup and get back to the business of accomplishing your litigation objective.  



In the final analysis, if the relationship is beyond repair then, like a bad marriage you should move on.
