FL Burglar Arrested Wearing 'Warning: I Do Dumb Things' T-Shirt ~ Call Michael A. Haber, Esq. @ 1-888-SHARK-8-1

DD was arrested on Thursday, April 23rd, 2015 in Naples, Fl in connection with a series of vehicle burglaries, and at the time he was donning the t-shirt that you see above (reading "WARNING I DO DUMB THINGS").  David, who was allegedly caught on plain-as-day surveillance video smashing a car window, then walking around a parking lot attempting to open car doors, was arrested for burglary, grad theft and criminal mischief.  He is also walking truth in advertising.




David's honest t-short arrest is not the first of it's kind.  I blogged in February, 2015 about Luciano Gutierrez (pictured below), a TX man who was arrested for his ninth (9th) DUI while donning the exact same t-shirt (you can read that prior blog post here).

WY State Prisoner Picks-up Federal Charges for Attempted Murder for Hire ~ Call Michael A. Haber, Esq. @ 1-888-SHARK-8-1




Met 23 y/o Andrew Silicani, 23, of Cheyenne, WY.  That is his April, 2012 MY mugshot below...




Andrew was sentenced in April, 2012 and was serving a five (5) to seven (7) year prison sentence for conspiracy to commit robbery and robbery resulting in bodily injury when during his stay at Rawlins State Prison, he made inquiry into having his parents killed.  Andrew contacted a person, who became a CI (confidential informant) to the FBI and who reported that Andrew had asked if the source would be willing to kill Andrew's mother and stepfather. FBI Agents instructed the CI to direct Andrew to correspond with an FBI agent who would pose as a hit man.  Naturally Andrew did, providing the supposed hit man with the names and address of his parents and saying that he didn't want to pay more than $100,000 for the "demolition work."  Andrew reportedly expected to receive $850,000 in life insurance and property, and the CI told law enforcement that Andrew was excited at the prospect of the murders and said he planned to buy "a Cadillac Escalade, clothes and jewelry."




Yesterday (on Monday, April 27th, 2015) Andrew pled guilty in federal court to four (4) counts of using the mail in his unsuccessful plan to hire someone to carry out the murders, and he now faces up to 40 years at sentencing this summer.  Andrew declined to follow the advise of his lawyer and refused the US Government's plea offer of 35 years, with the bonus of a guarantee that he would not face independent prosecution from WY State authorities for his attempt at "murder for hire" (yes, you read that right, it is NOT double jeopardy for two (2) separate sovereigns - a State and the Feds - to charge and prosecute and punish you fore the same offense.)




Accordingly, Andrew pled guilty to all of the federal charges against him with no agreement from prosecutors to recommend a lesser sentence, and now, having effectively poked the bear (by rejecting the US Attorney's plea offer) Andrew will likely also be independently prosecuted and sentenced by the State of Wyoming.




In recounting his actions to support his guilty plea (in federal court an "allocution" - a factual proffer admitting guilt - is required as a prerequisite to the Court accepting a plea), Andrew said to U.S. District Court Judge Nancy Freudenthal: "I used the mail, wrote four letters asking for this to be done — for the murders of my mom and stepdad. I understand what I've done. I felt that pleading guilty would be best."  Andrew added that he regarded his actions as "a big error in judgment — I'd take it back if I could.".  Judge Freudenthal replied by saying: "I think it's fair to say that you'll be looking at some time in custody". "Murder for Hire":  Like most crimes, it's only worth it if you don't get caught. 




Memo to Andrew (& the Folks):  Thirty-five (35) years is a long time, but you were caught dead to rights, planned on admitting guilt, faced forty (40) years and (plus) consecutive State prosecution and sentencing.  As painful as it sounded you should have listened to your lawyer. There are exceptions to every rule but, usually, we offer up advise which is in our client's not in our own, best interests.  Most of us (criminal defense lawyers) love litigation and trials.  In fact that is why most of us do what we do.  Not only does it give us pleasure and both a challenge and a sense of accomplishment, but it is in our financial interests (i. e. we usually make more money) to litigate as opposed to where a plea is taken.  




Sometimes a refusal to follow your lawyer's advise will work out for you, but usually not.

Fugitive Observed in Stolen Truck by Victim / Owner is Arrested after Chase and Crash ~ Call Michael A. Haber, Esq. @ 1-888-SHARK-8-1

Terry was arrested on Friday, April 24th, 2015 by Calhoun County, Alabama Police after a man who was driving to work suddenly noticed that his own stolen pickup truck - then being driven by Terry - was following him in Piedmont, Alabama.  That observation set off a chain of events which included a police pursuit, a crash, and an arrest.




Per Calhoun County, Alabama Police Chief Matthew Wade the vehicle had been swiped from the victim on his birthday and "The guy found his truck and it was right behind him".   Police attempted to pull over the reportedly stolen vehicle but the driver did not stop and a pursuit ensued until Terry crashed the vehicle and was ejected as the truck rolled over.  








Terry was captured after a foot chase.  Per Chief Wade:  "... you do bad things, and you're going to get caught.  And that's kind of how it goes, and this guy had warrants through - already had warrants through Cherokee County, he had warrants through Piedmont, he had warrants through us."  In fact, United States Marshals had been searching for Terry for two (2) weeks before he was haphazardly spotted by the owner of the truck that he had stolen. As of Friday Terry is in jail, without bond, facing both his old charges and his latest for theft and possession of burglary tools.





I'm surprised that Terry wasn't charged with "Fleeing & Eluding", which, in Florida, is a felony which carries and mandatory adjudication of guilt and a one (1) year driver license suspension... I suppose that is his "silver lining".

JFK Airport Employee is Arrested for Stealing $15k in Booze and Electronics ~ Call Michael A. Haber, Esq. @ 1-888-SHARK-8-1




Meet 48 y/o Juanette Cullum, pictured below, who is (er, who was) an airplane cleaner at JFK International Airport until her arrest last Friday (April 24th, 2015) for allegedly stealing almost $15,000.00 worth of items from Terminal 8 (American Airlines), including more than 1,400 unopened miniature bottles of liquor, nineteen (19) Kindle tablets, seven (7) iPads, two (2) laptops and a "large amount" of toiletries over a three (3) year period.





Per Port Authority Police a witness allegedly saw Juanette stealing property and informed American Airline officials who called cops.  A warrant was served on her home where all of the items were recovered.  A confession ensued and Juanette was charged with grand larceny and criminal possession of stolen property.




Memo to Juanette (& the Folks):  It's truly tough to defend a case when a client is caught red handed and is fingered by independent witnesses / evidence.  It is even more difficult where a warrant is lawfully obtained and served and contraband is then found in the same subject's home.  But the coup-de-gras comes when the individual subsequently confesses.  Please, pretty please, be a good (if not a smart client), and at least INVOKE.  If ever there comes a time for a Mia Culpa believe me your criminal defense lawyer will both advise you and structure the statement to achieve maximum benefit.  In the meantime, if you get popped, then...

WA Woman Hit's 5 y/o on Trike, Bails and Bolts & is Caught by Police K-9 ~ Call Michael A. Haber, Esq. @ 1-888-SHARK-8-1





Meet 36 y/o Marsha Yumi Perry of WA State.  That's her mugshot below...





Doesn't look happy does she?  Well she shouldn't.  On Friday, April 24th, 2015 Marsha got all up close and personal, having met "Ranger", a Washougal, WA Police K-9 who was being handled by Officer Kyle Day, and who had tracked her through a field after she had allegedly hit a five (5) y/o boy with her truck before hiding from officers by crawling into a hole and covering herself with dirt.





Cops were called after the five (5) y/o boy had ridden his tricycle out of a driveway and was hit by a car around 6:00 pm.  Witnesses told police that Marsha had tried to drive off from the scene of the crash but that she was unable to do so, prompting her to get out of her Ford pickup truck and walk away.  





Ranger was able to track her scent near to the shallow hole in which Marsha was hiding.  After Officer Day, who could not see her, warned her that he was about to unleash the dog, "the ground moved, and she sat up".  




Police said the boy suffered a cut to his face as well as scrapes to his knees and elbows, and he was taken to Peace Health Southwest Medical Center in Vancouver.  Marsha, on the other hand, was taken  to Clark County Jail, being charged with felony hit-and-run, driving with a suspended license and also on a misdemeanor warrant (for a previous arrested in Oregon in November 2014 on accusations of identity theft, being in possession of methamphetamine and providing false information to police.)   





Cops have stated that they do NOT believe that either alcohol or drugs were a factor, leading to the conclusion that Marsha likely fled because of her outstanding warrant.





Memo to Marsha (& the Folks):    Accidents (i.e. "spontaneous and unplanned occurrences") can and do happen, but they only result in an arrest where criminal behavior is attached to the unforeseeable event.  If booze and dope were not involved then perhaps Marsha was not to blame in this case (I know, perhaps she was, she could have been speeding or texting or applying makeup or any of a number of things, but it's just as likely that the victim rode out into the street leaving physics with no alternative... I'm just saying that without more evidence it's impossible to say what actually happened).  Her decision to bail and bolt (hit and run) was, however, criminal in nature.  I am not a WA lawyer and cannot comment on matters of WA law or procedure but if their law is anything similar to Florida's then a) there is a duty to remain on the scene of an accident (especially one involving injuries) and b) failure to do so is a criminal act.  Even if it was not an accident whatever crime may have occurred was seriously compounded by Marsha's poor decision to flee.
