Epic Parenting FAIL! A 9 y/o GA girl calls 911 to report her Father for Drunk Driving and Begs him to "stop the friggin' car" ~ Call Michael A. Haber, Esq. @ 1-888-SHARK-8-1




Meet 36 y/o Wesley Bergner, father of 2 girls, hotel manager...




... and apparently extremely poor decision maker, especially when he's been drinking.




(No, that is not Wesley's back... but it may as well be... read on....).  Wesley was on a road trip, driving his girls about 300 miles from Atlanta to his mother's house in St. Simons Island, Georgia when his 9 y/o daughter called 911 (you can hear some of the call by clicking here).
The 9 y/o girl's voice trembled with fear as she spoke to emergency dispatch:  "Hello, is this 911? The only person that's here is my dad and he's drunk. My dad is drunk. Help me, please! Help me!...  I don't know where we're going. He's driving really fast. I don’t know where he is taking me, but I think he is going to get into a wreck... I am a kid and I think my dad is driving drunk,  I know that my dad is drunk, and he is the only one driving, and I think that I am going to get into a wreck because he is the only one.  I don't know where I am right now. Daddy, stop the friggin car! Stop the car. Pull over somewhere!"  The girl was so terrified that the dispatcher had difficulty making out what she was saying at points during the seventeen (17) minute long (yup, 17 minutes) call.  




The girl was unfamiliar with her surroundings so the emergency dispatcher tried to lock down the vehicles location:

Dispatcher:  You don't see any businesses at all?

Child:  Um, well, coming up there's Oglethorpe Elementary.
Dispatcher:  Okay. She sees Oglethorpe Elementary.


Eventually the 9 y/o girl remembered her grandparents' address, and police officers swiftly turned up at her father's mother's home, where they found him to be "visibly intoxicated" and arrested him for DUI, Reckless Driving, Driving on a Suspended License and Child Endangerment (while DUI).




Memo to Wesley Bergner:  Epic parenting FAIL!  You couldn't wait until you got to grandma's house to get sauced?  Seriously?  Wtf?  Your daughter told the dispatcher that she saw two bottles of alcohol in the car and that you manipulated a breathalyzer device in the car... again, wtf?  I don't know if you have an alcohol problem or not but I am pretty comfortable going out on a limb and predicting that you have serious judgment issues.  You are lucky that you did not injure or kill anyone, like maybe your daughters...

When it comes to the subject of drinking and driving, the best advice that you are ever going to hear is:  "Don't do it!  Get a DD (Designated Driver), not a DUI".



Be smart{er than Wesley Bergner}: Don't drink and drive, but, if you do, just say "NO{thing}", don't blow (in FL your 2nd subsequent refusal is a crime) and call me stat at 305-381-8686, 305-798-2220 or 1-888-SHARK-8-1.

NY Reverend is Arrested for Possession of Child Porn, Crystal Meth & Xanax when Warrant is Executed at his Episcopal Church~ Call Michael A. Haber, Esq. @ 1-888-SHARK-8-1




Meet 51 y/o Reverend Christopher King, who, prior to Friday, February 3rd, 2017, lived and worked at the St. James of Jerusalem Episcopal Church in Long Beach, New York... That's him below.




The not so good Rev no longer works or resides at St. James (which is pictured below), having been fired after being arrested on five (5) counts of possessing a sexual performance by a child (cops reportedly found pornographic videos on his computer which showed boys as young as 2 or 3 years old performing sex acts on each other, or with adult men) and and two (2) counts of possession of a controlled substance (2 grams of crystal meth and non-prescribed Xanax pills). 




After receiving "a tip", Nassau County, NY Police secured a search warrant and raided the Rev's home, leading to his arrest at the church and this booking photo...




Memo to  Reverend Christopher King:  It's gonna take more than a few "Our Fathers" to get you out of this mess.  JC may forgive you, but when it comes to kiddie porn I suspect that you're gonna find that the the criminal justice system is not so forgiving. I would never dissuade you (or anyone else) from putting your faith in G-d, but in this case I urge you to team up with your skilled and experienced criminal defense lawyer. Social Media FAIL! Instagram Selfie Video Leads South FL Cops to find "Wheels Up Guns Down" Reckless Driver in NY ~ Call Michael A. Haber, Esq. @ 1-888-SHARK-8-1

Just look at those selfie smiles!




Fredo was participating in the annual unsanctioned "Wheels Up Guns Down" event" which has come to terrorize roadways and infuriate law enforcement as hundreds of participants (many from out of State) take to and rally upon Sooth FL roadways, flagrantly violating traffic laws, impeding flow and endangering themselves and others, all in the name of "peace".




Because participants dare to take chances that cops cannot or will not mimic (such as using their off road vehicles to drive against traffic, cutting across private property and so forth) only a few get caught, but those who do are increasingly being treated harsher by the cops, who have banded together across jurisdictional lines to combat the event.




Anyhow, as you can see from the still pictures above (which were taken from a video that Wilfredo Garcia, Jr. posted to Instagram, and which you can see by clicking here) Wilfredo Garcia, Jr. was a willing participant in this year's spectacle.  Per cops Fredo was cruising State Road 7 in Broward County, donning gold headphones and goggles as police vehicles gave chase with lights slashing and sirens blaring.  In the video you can hear Fredo yelling at cops to "shut up" as he continues to flee and elude the law.  Now ole' Fredo may have known that he was pissing off the cops but what he apparently did not account for was that the cops noticed that he was using a "selfie stick", prompting them think that he was recording himself (which he was), leading them to hit their computers and scour social media.




Imagine this:  Hollywood Police Officers searched social media for various keywords, including "#bikesupgunsdown", and lo and behold they came across Fredo's smiling, and incrimination, joyride video on Instagram.  The video alone was not enough to get cops to Fredo but as they scrolled through his other posts they came across one that clearly showed a PA license plate on a motorcycle, and a simple cross-reference through law enforcement databases led cops to A) Fredo's identity, B) his address, and C) a Judge - who issued an arrest warrant.




As of January 25, 2017 Fredo is sitting in a cell at Riker's Island awaiting extradition to Broward County to face felony charges for Fleeing and Eluding (a felony) and Reckless Driving (a misdemeanor).




In FL Fleeing to Elude a Law Enforcement Officer (or, “Fleeing & Eluding” or “F&E”) occurs where you: 1)  Drive a vehicle in Florida; 2)  And after a Law Enforcement Officer orders you to stop or remain stopped you... 3) Knowing that an order to stop had been given by a Law Enforcement Officer, either A) Willfully (i.e. intentionally, knowingly, and purposely) refuse or fail to stop the vehicle; or B)  After stopping the vehicle you willfully flee in an attempt to elude the officer. Fleeing to Elude is a 3rd Degree Felony which is punishable by up to 5 years in state prison and a $5,000 fine.  F&E carries a mandatory 1 year driver license suspension (which the Judge can bump up to as many as 5 years) & it also carries a mandatory adjudication of guilt, meaning that if you are found guilty then you will have a permanent felony conviction on your record. But, if you take the extra step of Fleeing & Eluding a Law Enforcement Officer with Lights and Siren Activated at a High Speed or while Driving Recklessly, then you can face a 2nd Degree Felony which is punishable by up to 15 years in state prison and a $10,000 fine.  You will also face a minimum mandatory 1 year driver license suspension (which the Judge can bump up to as many as 5 years) & it a mandatory adjudication of guilt, meaning that if you are found guilty then you will have a permanent felony conviction on your record. The bottom line is that if a cop wants to pull you over then you should pull over, and stay pulled over.  (You can watch HaberPA's VideoFAQ / YouTube Webisodes on "What is Fleeing to Elude a Law Enforcement Officer?" and "Can Fleeing to Elude be Enhanced?" by clicking on the video links below.)

Police Commissioner is Arrested by his own Department for Domestic Violence and apparently Mistakes his Mug Shot for a Glamour Shot ~ Call Michael A. Haber, Esq. @ 1-888-SHARK-8-1



Meet 52 y/o William Regan, the Police Commissioner of South Hackensack, NJ. That's his happy-go-lucky Facebook smiling self below...




And here he is again, all smiles in his January 26, 2017 booking photo....




Yes, you read that right, the South Hackensack Police Commissioner was arrested by the South Hackensack police, and, as you can see, the Commish is all smiles....




The Commish was reportedly charged with assaulting his wife in an alleged domestic violence incident ("simple assault with bodily injury") which occurred the day before his arrest.  Mrs. Commish reportedly alleged that her smiling hubby had grabbed her by the arms, pulled her to the floor and then dragged her along the ground, causing injuries to her arms and knees.  




The incident came just after Billy Boy was sworn in for a third term as commissioner last month.  Per his LinkedIn page (which you can access by clicking here) he has been commissioner since January 2016, prior to that he allegedly spent two years as South Hackensack's Mayor, and two more as deputy from 2012 to 2014.




Memo to the Folks:  I am making fun of this turd (both due to the obvious irony and because of his dumb ass mugshot... which begs for abuse) but make no mistake that domestic violence is not funny.  




Memo to the Folks continued:  Domestic Violence (DV) cases present wrinkles for everyone in the system (the Defendant, the State and the Court), as they almost always involve emotional charged folks who's lives are either interdependent or interconnected, the potential for repeat or escalated violence is almost always high and there is more often then not the likelihood that a victim will, for whatever reasons, wish not to prosecute the perpetrator.  For these reasons, in FL DV cases Defendant's suffer aggressive prosecution (more aggressive than many other offenses), the State feels obligated to "force" all victim's to "help themselves" (which serves the dual purpose of covering its own ass in the event of a subsequent violent altercation) and the Court engages in pure self-protection (no Judge wants to read her/his name in the paper as being responsible for "cutting loose" the repeat DV offender who re-injures, more seriously injures or kills a victim when the Court could have acted to prevent the same from occurring).  These are the practical realities of DV cases that we all must live with and it is for these reasons that there is a mandatory 24 hold (a statutorily required cooling-off period) for anyone booked into a FL jail for any DV case and that DV victim's are afforded special protections, are required to be evaluated (if only by responding officers who have a DV "checklist") and are required to be provided information about alternatives to returning to "life" with the alleged perpetrator).  




Memo to the Folks continued:  The last thing I want to say is that women may get the statistical brunt of domestic violence cases, but men are victims approximately 1 in 3 times.





Memo to the Folks continued:  So, next time you get frustrated, angry or outright irate, please, pretty please, walk it off.  Just get up and leave.  Better you leave on your own accord than in handcuffs.  (But if you do get arrested then don't be a jack wagon like William Regan... IT'S A BOOKING PHOTO NOT A GLAMOUR SHOT!).
